Personal Injury Claims

Protecting Your Rights

In the province of Ontario, there are rules and regulations that specify strict time limits with respect to filing a claim for compensation. Not being aware of these limitations can have potentially devastating implications. Missing the time limit can result in a claim being statute-barred and preclude the victim from filing a lawsuit altogether.

Limitations as well as other rules of civil procedure are just some of the things that one has to deal with as a potential claimant and that is why it is important to speak to a legal expert immediately after sustaining an injury.

Furthermore, personal injury law is one of the most complex legal fields in the province and requires extensive skills and resources in order to obtain all of the benefits and compensation that victims may be entitled to.

Motor Vehicle Accidents

Motor vehicle accidents are a common sight on Ontario roads and highways. We see them on our way to work and hope that we never face the same situation. Fortunately, the province of Ontario has legislation in place that was designed to protect car accident victims. Regardless of fault and whether you were a driver, passenger, pedestrian, or cyclist – you have rights.

In Ontario, all car accident victims are entitled to what is called Accident Benefits. These benefits are there to primarily cover medical treatment and lost wages. However, those suffering from more severe injuries are potentially entitled to additional benefits such as Attendant Care and Care-giving.

Victims of car accidents may also be entitled to file what is called a Tort Claim against the at-fault party. This means the injured person can seek to recover compensation for damages such as Pain and suffering, Loss of enjoyment of life, Loss of income and competitive advantage, Medical costs, and Out of pocket expenses.

Even if the other driver did not have valid insurance or fled the scene – you are still covered. In situations where coverage is not available due to aforementioned circumstances, the injured party can file a claim with the Motor Vehicle Accident Claims Fund which will provide Accident Benefits and potentially additional compensation.

The above information is just the basic framework of the very complex and often confusing system which can be very difficult to navigate without the assistance of an experienced personal injury law firm. There are strict time limits which must be adhered to in order to be eligible for certain benefits and if these limitations are missed, the victim may be prevented from filing a claim altogether.

Slip, trip and fall accidents can be caused by a wide range of circumstances such as adverse weather conditions, lack of proper maintenance and repairs to pavement, and even something as simple as failure to clean up a spill by the staff at your local supermarket.

The process of filing a claim for compensation resulting from a slips, trips or falls is unique in the senses that it is absolutely imperative to identify the responsible party. In some cases there may be more than one party that contributed to the negligence which resulted in the victim’s injuries. Furthermore, there are strict time limits applicable to filing of these claims which can be as short as 10 days. Missing these important limitations can result in having a claim “statute-barred” which means that a victim is no longer able to file a claim altogether.
